1. Who We Are and Acceptance
EchoTalks (the 'App') is a self-help mental-wellness and journaling service operated from Hong Kong by ECHOTALKS AI TECHNOLOGY LIMITED. These Terms of Use form a legal agreement between you and ECHOTALKS AI TECHNOLOGY LIMITED. By creating an account, purchasing a subscription, or using the App, you agree to these Terms and to our Privacy Policy. 2. Eligibility
You must be at least 13 years old to use the App. If you are 13 or older but under the age of majority where you live, you must use the App with the consent of a parent or guardian, who must read and accept these Terms on your behalf. By using the App, you confirm that you meet this requirement.
The App is for your own personal, non-commercial use, and you are responsible for the accuracy of the information you provide.
3. The Service
EchoTalks uses artificial intelligence to provide conversational support, mood tracking, journaling, weekly and monthly reviews, and general self-reflection and wellbeing features. It is designed to support general self-help and emotional wellbeing. It is not a medical service and is not intended to replace professional care.
4. Not Medical Advice
EchoTalks does not provide medical advice, diagnosis, or treatment, is not a medical device, and is not a substitute for care from a qualified doctor, therapist, psychiatrist, or other mental-health professional. Content generated by the App is general in nature and may not suit your situation. Always seek professional advice before making decisions about symptoms, diagnosis, medication, or treatment, and never delay or stop professional care because of something the App told you.
5. AI Limitations
The App's responses are generated by artificial intelligence. AI-generated content may be inaccurate, incomplete, or inappropriate, may misunderstand you, cannot verify what you tell it, does not exercise professional clinical judgement, cannot guarantee your safety, and cannot reliably identify every crisis. You are responsible for evaluating AI responses before relying on them, and should consult a qualified professional where professional judgement is needed.
6. No Therapeutic Relationship
Using the App does not create a doctor-patient, therapist-client, counsellor-client, or any other professional or fiduciary relationship between you and EchoTalks or the AI. Even where the App uses therapeutic concepts or evidence-informed exercises, this does not mean that professional therapy is being provided.
7. Emergencies and Crisis Situations
The App is not an emergency service and is not monitored by humans in real time. Do not rely on it if you may harm yourself or another person, are in immediate danger, or are experiencing a medical or psychiatric emergency.
We do not guarantee that the App will recognise an emergency, and we do not contact emergency services, your family, or your friends, and cannot locate you. In an emergency in Hong Kong, call 999 or go to the nearest Accident & Emergency department; elsewhere, contact your local emergency number or a crisis hotline immediately.
8. Your Account
You are responsible for keeping your login credentials secure, for all activity under your account, and for telling us promptly of any suspected unauthorised use. Do not share your account where doing so may expose your sensitive information to others. We may require verification before processing certain requests, and you may delete your account at any time from within the App.
9. Acceptable Use
You agree not to: use the App for any unlawful purpose; harass, threaten, or abuse others; promote suicide or self-harm; submit another person's information without permission; attempt to access another user's account; disrupt, reverse-engineer, or gain unauthorised access to the App; introduce malware; scrape or harvest data; bypass safety or usage limits; use the App to train a competing AI model without our written permission; or present AI output as professional advice from a licensed professional. We may suspend or terminate accounts that break these Terms.
10. Your Content and Feedback
You keep ownership of the content you create, such as journal entries and messages ('Your Content'). You grant us a limited licence to store, process, and transmit Your Content only to operate, secure, and improve the App, including sending it to our AI providers to generate responses as described in the Privacy Policy. This licence ends when the content is deleted, except where retention is technically or legally required.
You confirm that you have the right to submit Your Content. If you send us ideas or feedback, we may use them to improve the App without any obligation to you.
11. Intellectual Property
The App and its software, design, branding, and content are owned by or licensed to ECHOTALKS AI TECHNOLOGY LIMITED. We grant you a limited, personal, non-exclusive, non-transferable, and revocable right to use the App for personal, non-commercial purposes. You may not copy, distribute, sell, sublicense, modify, or create derivative works from the App, or remove any proprietary notices, except as allowed by law.
12. Subscriptions and Payments
Some features require a paid subscription. Purchases are made through your Apple App Store or Google Play account and managed with the help of our subscription provider, RevenueCat. Before you buy, the App shows the price, billing period, and any free trial.
Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period; manage or cancel them in your store account settings. Deleting the App or your account does not cancel a store subscription. Except where required by law, payments are non-refundable, and store purchases are subject to the store's refund rules. Nothing here excludes a consumer right that cannot legally be excluded.
13. Availability and Changes to the Service
We aim to keep the App available but do not guarantee that it will be uninterrupted or error-free; it may be unavailable due to maintenance, technical or network problems, third-party failures, or circumstances beyond our control. We may add, change, or remove features, change our AI or other providers, set reasonable usage limits, or discontinue part or all of the App. Your wellbeing should never depend solely on the availability of the App.
14. Disclaimers, Limitation of Liability, and Indemnity
The App is provided on an 'as is' and 'as available' basis without warranties of any kind. To the maximum extent permitted by law, EchoTalks and its providers are not liable for any indirect, incidental, special, or consequential loss, including loss of data, emotional distress, or loss arising from reliance on AI responses or from a failure to identify a crisis; and our total liability relating to the App is limited to the amount you paid for it in the 12 months before the event giving rise to the claim.
To the extent permitted by law, you agree to indemnify us against claims arising from your unlawful use of the App, your breach of these Terms, or content you had no right to submit. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including for fraud.
15. Governing Law, Termination, Changes, and Contact
These Terms are governed by the laws of Hong Kong, without affecting mandatory consumer protections in the country where you live. Before starting formal proceedings, please contact us at [email protected] so we can try to resolve the matter; otherwise, disputes are subject to the courts of Hong Kong.
You may stop using the App and delete your account at any time; we may suspend or terminate access if you break these Terms or as required by law, and the sections that by their nature should survive (such as the content licence, intellectual property, disclaimers, limitation of liability, and governing law) will continue to apply.
